By Final Order and Judgment dated and entered on March 5, 2014, the United States District Court for the Eastern District of Pennsylvania granted final approval of the class action settlement and entered final judgment in this matter, as more fully put forth in the Settlement Agreement and other documents available on this website and involving the following products:
Composite decking, railing, or fencing material sold under the brand or trademarks: Veranda® Composites Decking, Veranda® Traditions Composite Decking, Veranda® TD Composite Decking, Fiberon® M Pro Series Composite Decking, Fiberon® Tropics, Fiberon® Classic™ Composite Decking Or Portico® Composite Decking.
The Class certified for purposes of this settlement is defined as follows:
All persons residing in the United States who own residences or commercial buildings (excluding those in “marine environments” as defined below) in the United States with a deck constructed of composite decking, railing, or fencing material sold under the brand or trademarks Veranda® Composites Decking, Veranda® Traditions Composite Decking, Veranda® TD Composite Decking, Fiberon® M Pro Series Composite Decking, Fiberon® Tropics, Fiberon® Classic™ Composite Decking Or Portico® Composite Decking, and purchased and installed there after March 12, 2008. For purposes hereof, marine environments means all commercial properties any part of which is within 500 feet of water (e.g., oceans, seas, bays, inlets, rivers, streams, lakes, other bodies of water), and thus such properties are excluded.
This Settlement and the Final Order and Judgment are binding on all persons described in the Class definition above, except for those who filed an effective request for exclusions from the settlement with the Court no later than October 31, 2013.
All Claims must be submitted in accordance with the Settlement Agreement, as to timeliness, method and content of the Claim. Claims are due no later than June 9, 2014; Claims are timely if the completed Claim Form and all required supporting documentation are received by the Fiberon Settlement Administrator by the due date, or if the completed Claim Form and all required supporting documentation are mailed (U.S. Postal Service first class or higher service) or emailed to the Fiberon Settlement Administrator at the address below by the due date. Claims that are not submitted timely and in accordance with the requirements under the Settlement Agreement and Final Order and Judgment will not be accepted. Claim Forms are available on this website, as are the requirements for submitting a valid Claim Form.
